Zynthera provides creative media and digital content services. These Terms govern your use of our website and Shopify store, and any purchases of services, digital goods, or deliverables.
By accessing the site, placing an order, or using any part of the Services, you agree to these Terms. If you do not agree, do not use the site or purchase from us.
1) About Zynthera & Scope of Services
“Zynthera”, “we”, “us”, and “our” refer to the business operating this Shopify storefront and providing creative production services, including but not limited to: dynamic video content for online platforms, production of visual assets and brand animation, media production and creative video materials, and video presentations/marketing video content (collectively, the “Services”).
These Terms apply to all visitors, customers, and users of our website, store, and related services, including interactions through forms, email, or other channels that lead to a purchase or project engagement.
2) Eligibility, Accounts, and Customer Information
You must be at least the age of majority in your jurisdiction to purchase from us. You agree to provide accurate, current, and complete information when placing an order or submitting project details. You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account.
3) Orders, Pricing, Taxes, and Payments
Prices are shown at checkout and may change without notice. We reserve the right to correct errors, misprints, or inaccuracies, including after an order is submitted. We may cancel orders if we suspect fraud, unauthorized activity, or violations of these Terms.
- Payment processing: Payments are processed through Shopify and its payment providers. We do not store full card details.
- Taxes/fees: Taxes may apply depending on your location and will be calculated at checkout where required.
- Chargebacks: If you believe a transaction is unauthorized, contact us first so we can help resolve it quickly.
4) Service Projects: Workflow, Timeline, and Revisions
4.1 Project Start & Client Inputs
Service work often requires client inputs (brand guidelines, assets, scripts, references, approvals). You agree to provide these inputs in a timely manner. If approvals or materials are delayed, delivery dates may move accordingly.
4.2 Milestones & Delivery
Timelines can be stated on the product page, in checkout notes, or in a written scope (SOW). Delivery may be made via download links, cloud storage, email, or a client portal. Unless explicitly stated, timelines are estimates.
4.3 Revisions
Revisions are limited to what is included in your purchased package or agreed in writing. Additional revisions, major scope changes, or new creative directions after approvals may require additional fees and timeline adjustments.
4.4 Client Responsibility for Rights
If you supply third-party materials (music, footage, logos, trademarks), you represent that you have the necessary rights or licenses. You are responsible for ensuring the materials can be used commercially in the jurisdictions where you operate.
5) Digital Products and Downloads
If we offer digital products, access will be provided through the method described at checkout (download page, email link, etc.). You are responsible for ensuring your device and software can open the provided file formats. If you have access issues, contact us and we will attempt to re-deliver or provide reasonable support.
6) Intellectual Property, Licensing, and Portfolio
All content on the site (text, graphics, visuals, code, UI, templates) is owned by Zynthera or licensed to us and is protected by law. For custom work, licensing depends on the scope purchased and/or written agreement.
- Final deliverables: upon full payment, you receive a non-exclusive, worldwide license to use the final deliverables for legitimate business purposes.
- Working/source files: not included unless explicitly stated in writing (e.g., editable project files).
- Portfolio use: unless you request confidentiality in writing, we may showcase completed work (or excerpts) in our portfolio/case studies.
7) Prohibited Use
You agree not to:
- Use the Services for illegal purposes or to violate regulations;
- Infringe intellectual property, privacy, or other third-party rights;
- Upload malware, attempt unauthorized access, or disrupt site operations;
- Harass, abuse, or engage in harmful conduct toward others.
8) Disclaimers and Limitation of Liability
The Services are provided “as is” and “as available.” We do not guarantee uninterrupted access, error-free operation, or specific commercial results (e.g., sales, engagement, ad performance) unless explicitly agreed in writing.
To the maximum extent permitted by law, Zynthera is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill. Our total liability for any claim is limited to the amount paid for the product/service that gave rise to the claim.
9) Termination, Changes, and Disputes
We may suspend or terminate access if you violate these Terms, if required by law, or to protect security and operations. If a dispute arises, we encourage you to contact us first to attempt a good-faith resolution.
